The US Senate has just passed The Matthew Shepard bill, which will expand federal hate crime laws to include crimes that are "based on sexual orientation, gender, gender identity and disability". It's mind blowing to think that hate crimes only included crimes that were "motivated by bias based on race, color, religion or national origin" up until now. (And by "mind blowing" I mean embarrassing and pathetic.) Matthew Shepard was a 21-year-old young man who was killed in 1998 by a homophobic group in Wyoming, and his parents are very pleased with the passing of the bill:
"The Matthew Shepard Act is an essential step to erasing hate in America and we are humbled that it bears our son's name. It has been almost nine years since Matthew was taken from us. This bill is a fitting tribute to his memory and to all of those who have lost their lives to hate."

The Military Commissions Act, passed in September 2006 as a last gasp of the Republican-controlled Congress and signed into law by Bush that Oct. 17, made significant changes to the nation's judicial system.
The law allows the president to designate any person an "alien unlawful enemy combatant," shunting that individual into an alternative court system in which the writ of habeas corpus no longer applies, the right to a speedy trial is gone, and justice is meted out by a military tribunal that can admit evidence obtained through coercion and presented without the accused in the courtroom, all under the guise of preserving national security.
Habeas corpus, a constitutional right cribbed from the Magna Carta, protects against arbitrary imprisonment. Alexander Hamilton, writing in the Federalist Papers, called it the greatest defense against "the favorite and most formidable instruments of tyranny."
The Military Commissions Act has been seen mostly as a method for dealing with Guantánamo Bay detainees, and most journalists have reported that it doesn't have any impact on Americans. On Oct. 19, 2006, editors at the New York Times wrote, in quite definitive language, "this law does not apply to American citizens."
Investigative journalist Robert Parry disagrees. The right of habeas corpus no longer
exists for any of us, he wrote in the online journal Consortium. Deep down in the lower sections of the act, the language shifts from the very specific "alien unlawful enemy combatant" to the vague "any person subject to this chapter."
"Why does it contain language referring to 'any person' and then adding in an adjacent context a reference to people acting 'in breach of allegiance or duty to the United States'?" Parry wrote. "Who has 'an allegiance or duty to the United States' if not an American citizen?"
Reached by phone, Parry told the Guardian that "this loose phraseology could be interpreted very narrowly or very broadly." He said he's consulted with lawyers who are experienced in drafting federal security legislation, and they agreed that the "any person" terminology is troubling. "It could be fixed very simply, but the Bush administration put through this very vaguely worded law, and now there are a lot of differences of opinion on how it could be interpreted," Parry said.
Though US Sens. Patrick Leahy (D-Vt.) and Arlen Specter (R-Pa.) moved quickly to remedy the situation with the Habeas Corpus Restoration Act, that legislation has yet to pass Congress, which some suspect is because too many Democrats don't want to seem soft on terrorism. Until tested by time, exactly how much the language of the Military Commissions Act may be manipulated will remain to be seen.

MAD LOVE

we lived on Fucking Street, the only street in haragaisa that had a name (or the only memorable one, anyway). our neighborhood was more orderly than most places in somalia. the houses were in rows. but, as if to redeem this concession to logic, the numbers weren't in sequence, our house was number 117; next door was 82; and the house after that didn't have a door at all. a crazy old woman named ardo balwo lived there, along with her goats, cats and son, known in the neighborhood as mohamed cawar-mohamed the cross-eyed. she acquired him as a deposit for unpaid rent for the house across the street,which she let out to the local prostitutes. mohamed's birth mother was a prostitute famous for her big tongue. she had no known name other than Big Tongue.

when i looked around it was pitch black
then there was no sound
then pretty soon the blackness went away and i see sort of a grey
and moving people
i woke up saw an incredible sight
people with their eyes hanging out
people who were completely burned
their skin was shredded and hanging off their bodies
"please help me! please help me!" they cried out
people with no arms
no legs
their intestines spilling out
brains spilling out of their crushed skulls
and near ground zero
bodies were carbonized
burned beyond recognition.
so many dead
one woman was carrying a baby
the baby had no head
i was so scared
the woman said "give me water."
i felt paralyzed
what could i do?
i was 10 years old
i had to help my sister
so i left the woman to help my sister.
at our orphanage there were a lot of little babies
most of them died instantly
crushed when the building collapsed.
my sister passed out
i tapped on her head until she came to
she cried out "mommy! mommy!"
we huddled together crying "mommy!"
we cried for help but no one came
from under the rubble my father cried for help
my sister was already dead crushed
from when the house collapsed
my little brother was trapped under the house
then flames swallowed our house.
my little brother was screaming
"mommy it is so hot. it is so hot!"
we could hear him as he died.
my mother told my brother
"i will die with you."
they asked for water and then they died
black rain started falling
it stained everything black
the boy's face was swollen
his eyes were gone
his body was completely burned
i could not believe it was my brother
i found the bones of 2 people
it was my mother and my grandmother
my sister disappeared
i found a burned body that had two holes
where the eyes would be
and one gold tooth
my mother had one gold tooth so that is how
i knew it was her i called to my sister,
"hurry i found her!"
we reached out and said "mommy!"
before our eyes it crumbled into ashes
the worst thing was maggots eating my flesh
that was pure hell
we would beg the nurses to kill us
adults and children alike
i asked them "why ? why did you kill my family?
give them back to me!"
of course they did not understand me and just smiled at me.

Genocide Conundrum: People Sympathize With Individuals in Trouble More Than Large Groups

At the annual meeting last month of the American Association for Advancement of Science, Paul Slovic, a psychology professor at the University of Oregon, recommended a review and overhaul of the 1948 Genocide Convention. He offered two related reasons. The first is that it has been completely ineffective, and the second is that it doesn't accord well with our human tendency to be moved by dramatic individual tragedies and unmoved by mass killings.

The sentiment is not new. Stalin famously noted, "One death is a tragedy; a million is a statistic."
What is new are a couple of experiments that elucidate this unfortunate tendency. Slovic remarks, "We have to understand what it is in our makeup -- psychologically, socially, politically and institutionally -- that has allowed genocide to go unabated for a century. If we don't answer that question and use the answer to change things, we will see another century of horrible atrocities around the world."
Sympathy for One Child, Less for Two Children
An important ingredient in our makeup is that we respond more emotionally to individuals than we do to groups, even small ones.
One Slovic study (done with colleagues Daniel Vastfjäll and Ellen Peters) focused on respondents who were shown a picture of a starving African girl along with text detailing her individual plight. A second group of respondents was shown a picture of a starving African boy with accompanying text, and a third group was shown a picture with the children together and accompanying text describing their situation.
The researchers made some measure of the sympathy each photo elicited and of the amount of money people were willing to donate to the girl alone, to the boy alone, or to both. The individual photos and text elicited approximately equal sympathy and donations, but the joint photo and text elicited less.
Even if the number of people in a group is only two, it seems that our capacity to feel begins to decline. Other studies show it declines more precipitously for groups of five or 10, and the difference in our responses to, say, 57 or 58 deaths is indistinguishable.

fuck la. fuck the heat. fuck everything. fuck your body. why sleep? fuck sleep. can't sleep in this fucking heat. wake up every 5 minutes in this heat. wake up at 7 am in the humidity. it's gross. fuck life fuck everything. i have been fucking out of my head for atleast 4 days now because of the heat. i was driving home from the smell after watching mika miko and i realized that my brain and body were wired, so wired, and i was wired for days, and still am. it's like being on drugs for a week straight. this house has no airconditioning. hot summer nights have always started riots. riot because it's hot. because it's unbearable, because the heat is unbearable. fall into the ocean and cool down and come out and you are still on fire. sleep in water. sleep under cold water. your body is burning up and if this goes on any longer you will have completely lost your mind. 2:32 am, los angeles, california, fuck it.


All Xiu Xiu tour books (1-5) are now being catalogued in the Museum of Contemporary Art Los Angeles library. the day is less hot.

dear jamie stewart,
i had a dream with you in it. we (you and i) were part of a crew on a ship. a crew that fished the waters for cats... as in, we would throw a net out into the ocean and pull up perfectly dry housecats. i don't quite know what the reason was that we did this but i think it had something to do with fur. anyways, we throw the net and pull up one cat - an orange tabby - and the rest of the crew is hurriedly instructing me to first wrap a fishing line around its neck and torso and then use this weird device they had that would insert these brads on the cat (kinda like the Beadazzler that would embed plastic jewels into clothing - but with cats) for it to be hoisted up in some way. i myself love cats and thought this wrong in the dream. then you telepathically communicated to me that you didn't want me to do it. you said "i don't want you to do this." the other crew members had started to use the cat beadazzler already on the poor thing. i snatched the cat up and began to unwrap it from the line and net and to pull the brads from its skin - insanely enough, it stayed completely still and so did the rest of the crew who were initially devoted to the cause. i carefully removed each brad and held the cat close. and then woke up. i don't know why i felt compelled to tell you about this - maybe you'd find it amusing. anyhow, you have a good day.-wes
